By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access our services.

Your Account

If you create an account on the Service, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with the account. You must not use QualCheckers to send unsolicited messages that could be considered spam. You must immediately notify Qualtrics of any unauthorized uses of your account or any other breaches of security.

Content

You are solely responsible for all data, text, software, sound, photographs, graphics, videos, messages, files, or other materials transmitted, posted, or distributed by you through the Services, including, but not limited to, contents of your email communication, information, reviews, and photos or images posted by you in any of your accounts. All Content posted by you is your sole responsibility.

QualCheckers does not control the Content posted by users such as you via the Services and, as such, does not guarantee the accuracy, integrity, or quality of such Content. Under no circumstances will QualCheckers be liable for any Content posted by any user or third party, including, but not limited to, liability for any errors or omissions in any Content or for any loss or damage incurred because of the use of any Content posted, emailed, or otherwise transmitted via the Services.

User Conduct

QualCheckers reserves the right – but does not assume responsibility – to monitor or review your conduct within the QualCheckers Services. Your use of the QualCheckers Services is subject to all applicable local, state, national, and international laws, and regulations. You agree not to use QualCheckers for any illegal purposes, disrupt networks connected to QualCheckers, collect or misuse information about other users, transmit through the QualCheckers Services any unlawful, harassing, defamatory, abusive, threatening, harmful, vulgar, obscene, sexually explicit, or otherwise objectionable material, create a false identity for the purpose of misleading others as to your identity or the origin of any message, transmit or upload any material that contains viruses or harmful content, attempt to gain unauthorized access to the Services, other accounts, computer systems, or networks connected to the Services, or engage in any conduct that, in QualCheckers sole discretion, is considered inappropriate, unauthorized, or objectionable.

Email Newsletters

As a registered QualCheckers user, you will automatically receive our email newsletters to keep you informed about our key features, important feature updates, and latest releases. These newsletters may include material that may be promotional in nature. At any time, you can choose to stop receiving them by clicking on the unsubscribe link at the bottom of the newsletter.

Please note that even if you unsubscribe from receiving our newsletters, you will continue to receive important email messages from QualCheckers, which may include service-related information and information related to your account such as account upgrade and subscription-based notification.

Payment Information

All information that you provide in connection with a purchase or transaction or other monetary transaction interaction with the Service must be accurate, complete, and current. You agree to pay all charges incurred by users of your credit card, debit card, or other payment method used in connection with a purchase or transaction or other monetary transaction interaction with the Service at the prices in effect when such charges are incurred. You shall pay all applicable subscription fees, including any sales, excise, service, use or other taxes now or hereafter imposed upon or required to be collected by QualCheckers by any authority in connection with or arising from the Service and/or this Agreement.

Subscription Terms

You acknowledge and agree that you shall be responsible for paying all fees due for the full term of your subscription, whether you cancel such subscription prior to the end of such term. You further acknowledge and agree that the term of your subscription shall automatically renew for additional successive terms equal to the period of your initial term, unless you cancel your subscription prior to the end of the then-current subscription term.

Cancelations and Refunds

QualCheckers does not tie you to a contract. Your subscription will renew every month. You can cancel your subscription at any time by going to the “My Account” section of your account and clicking on “Cancel My Subscription.”

Termination

QualCheckers may terminate your access to all or any part of the Service at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your QualCheckers account (if you have one), you may simply discontinue using the Service. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Indemnification

You agree to indemnify and hold harmless QualCheckers, its contractors, and its licensors, and their respective directors, officers, employees, and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Service, including but not limited to your violation of this Agreement.

Limitation Of Liability

In no event will QualCheckers, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed the fees paid by you to QualCheckers under this agreement during the twelve (12) month period prior to the cause of action. QualCheckers shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

Modifications to our Terms and Conditions

QualCheckers reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Service following the posting of any changes to this Agreement constitutes acceptance of those changes. QualCheckers may also, in the future, offer new services and/or features through the Service (including, the release of new tools and resources). Such new features and/or services shall be subject to the terms and conditions of this Service.
